Terms and Conditions.

1. Introduction

  1. A contract is formed between a customer (referred to as the “Customer”) and Studio M (referred to as the “Company”) when an appointment is booked by the Customer. An Order may be in written, verbal or electronic form. The Product or Service shall mean any product or service that is provided by the Company to the Customer. These conditions do not affect your statutory rights.

2. Supply

  1. The Company agrees to supply the product(s) or service(s) to the Customer as detailed in the Order and according to the terms and conditions of this contract.

3. Rights Reserved

  1. Should the Company choose not to enforce any or all of these conditions it should not be interpreted as a waiver of any of the Company’s rights. By providing the Company with an Order, the Customer accepts these terms and conditions.

4. Payment & Prices

  1. The Company shall issue an invoice (either written or verbal) to the Customer in respect of products or services supplied, or to be supplied. Payment terms will be stipulated within the invoice issued by the Company. These may include non-standard or special clauses which the Company may reasonably request of the Customer.

  2. The company can charge interest under the Late Payment of Commercial Debts (Interest) Act 1998 at the rate as deemed reasonable by the Courts and as deemed reasonable in excess of the percentage quoted by the Bank of England and the Courts. Title in the goods or services shall remain with the Company until full payment has been received, unless otherwise stipulated in the Order.

  3. You may pay us for Services and/or Products (and for any booking fee/deposit or other advance payment on account of that payment) using any of the following methods: cash, bank transfer or gift voucher.

  4. We may alter our prices without prior notice, and your appointment will be charged at the current price list rate on the date of your appointment. Our prices are subject to change without notice.

5. Deposits

  1. We reserve the right to request a deposit in order to secure an appointment. Any changes to the appointment must be made in accordance to the cancellation policy.

6. Appointments

  1. Please arrive at your booked appointment time prior to your treatment. Late arrival will result in a shortened treatment time, however treatments will still be charged at full price.

  2. For late arrivals longer than 15 minutes we reserved the right to cancel your appointment and an appointment cancellation fee will be added to your next appointment.

7. Cancellations

  1. Cancellations made 72 hours or less before an appointment will be subject to a rebooking fee of the full treatment cost.

  2. Cancellations made to Studio M via, email or telephone sooner than 72 hours before an appointment will be processed without penalty.

  3. You can cancel or reschedule an appointment by emailing us at melissa@studiom.uk, texting (07584241977), requesting through the web portal on studiom.uk (Request an appointment), or calling at (07584241977).

  4. Cancellations made 72 hours or less before an appointment will be subject to a charge of the full service rate. This includes appointments where our service provider cannot access the property, is turned away, or the client is unavailable.

  5. If Studio M cancels an appointment with less or more than 72 hours notice, a new appointment will be scheduled without penalty to the client, subject to availability.

  6. The cancellation fee must be paid before any subsequent appointments can be made.

8. Skin Testing

  1. Skin testing may be required for several treatments to ensure the safety of the client and must be completed before your appointment. The result of the patch test will be used to determine the correct and safe route of treatment within the salon.

  2. We reserve the right to refuse any treatment that requires a patch test if it has not been completed 24/48hrs prior to your appointment. Failure to complete a patch test before your appointment will result in cancellation and our cancellation policy will apply.

9. Gift Vouchers

  1. Gift Cards can be spent on any service at Studio M up to the value of the card.

  2. The gift card cannot be exchanged for cash after purchase and cannot be replaced or reimbursed if lost or stolen.

  3. Gift vouchers are non-refundable and are valid for 12 month from the purchase date of the card.

  4. Gift cards will not be accepted after the 12 month period has expired.

  5. Vouchers may be used for services only.

  6. Gift Vouchers cannot be redeemed for cash, sold or transferred.

  7. You are not under obligation to use the full value of your vouchers during one session.

  8. Late cancellation and "failure to show" terms as laid out above also apply to gift vouchers.

10. Liability

  1. The Company accepts no liability for any loss or damage that may arise from the supply of the product(s) or service(s).

  2. In the unlikely event of the Company being unable to supply the product(s) or service(s) as specified in the Order, liability shall be limited to the total invoice value – or monies already paid by the Customer.

11. Copyright

  1. Unless otherwise stated in the Order, the Company retains copyright in all their Original Material. Original Material includes products or creative productions of their service video recordings, graphics, soundtracks, printed material and any other design or artwork commissioned by the Customer in relation to the Order.

  2. The Customer must ensure that permission is sought for the inclusion of any copyright material they supply to the Company to enable them to deliver the product(s) or service(s).

  3. The Customer must also ensure that permission is sought for the inclusion of any performers or performances, trademarks and locations.

  4. The Company retains the right to use this material in its original and edited form as they see fit, unless otherwise agreed in the Order.

  5. The Customer agrees to indemnify the Company in the event of any breach of copyright claims being brought against the Company in respect of material supplied by the Customer.

12. Data Protection

  1. The Customer must ensure that all necessary arrangements have been made with, and permissions obtained from, people and places that may be recorded on video or photo as a result of the Company supplying the product(s) or service(s) – and that such recordings are compliant with Data Protection.

  2. The Company has the right to record, store and distribute any video, photo and audio data on its premises and on the premises or private property of any customer they are currently providing a service to for security and marketing purposes, unless agreed otherwise.

13. Care and Damage to Client Property

  1. Whilst every care is taken in the handling of the Customer’s property, the Company accepts no responsibility whatsoever for any loss or damage, howsoever caused, or any other loss by unforeseen circumstances whilst services are being carried out at a Customer’s property.

14. Confidentiality

  1. Unless otherwise agreed the Company will treat any information gained during the supply of the product(s) or service(s) as being private and confidential. Likewise, the Customer shall keep confidential any methodologies and technology used by the Company to supply of the product(s) or service(s).

15. Basis of law

  1. These Terms and Conditions and any accompanying letter, invoice and/or contract are governed by the laws of the United Kingdom.

16. Reviews

  1. If you submit a review, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

  2. You grant studiom.uk and its sub-licensees the right to use the name that you submit in connection with such content, if they choose.

  3. You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.

  4. You agree to perform all further acts necessary to perfect any of the above rights granted by you to Studio M, including the execution of deeds and documents, at the request of Studio M.

  5. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to studiom.uk:

  6. The content and material is accurate;
    Use of the content and material you supply does not breach any applicable rush.co.uk guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify studiom.uk for all claims brought by a third party against Studio M arising out of or in connection with a breach of any of these warranties.

17. Force Majeure

  1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (a ‘Force Majeure Event’). 

  2. Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and We will have an extension of time for performance for the duration of that period. We will use Our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which Our obligations under the Contract may be performed despite the Force Majeure Event. 

18. Products & Services

  1. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

  2. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
